The Web address, pi-tag.com and pi-tag.co.uk, and also known as the 'pi-tag service' is operated by pi-tag Ltd and (referred to as “we”, “us” and “our”). The site is subject to the following terms and conditions.

Your Consent

By using this Web Site (“Site”), you agree to these Terms of Use. If you do not agree to these terms, we ask that you not use this Site.

We reserve the right to modify or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, updates and revisions. You should visit this page from time to time to review the current terms.

Copyright

All content provided on this Site, such as text, graphics, images, etc., is our property and is protected by United Kingdom and international copyright laws. The collection, arrangement and assembly of all content on this Site is our exclusive property and is protected by United Kingdom and international copyright laws. Except as stated herein, no material for the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. Any unauthorized use of any material contained in this Site is strictly prohibited.

Trademarks

The trademarks, service marks and logos (“Trademarks”) used and displayed on this Site are our registered and unregistered Trademarks, unless otherwise noted. Nothing on this Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Site. Our Trademarks may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.

Use of Site

This Site or any portion of this site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose that is not expressly permitted by us. We reserve the right to refuse services, and/or cancel accounts at our discretion if we believe that customer conduct violates applicable law or is harmful to our interests.

pi-tag.com stores email addresses and mobile telephone numbers on an online database, in order to offer registered users a secure contact service. All registered users must be aged over 16 years of age. If you do not wish to make your contact details available to other pi-tag users, you should not register on pi-tag.com. By accepting these Terms of Use, you agree that your email address and where entered, your mobile telephone number, will be stored on one of our secure servers.  Your email address and mobile telephone number will not be shown to anyone online.

You must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify pi-tag.com immediately of any unauthorized use of your account or any other breach of security. pi-tag.com will not be liable for any loss that you may occur as a result of someone else using your password or account, either with or without your knowledge. You may not use anyone else's account at any time, without the permission of the account holder.

You agree that registrations are restricted to one per user. You also agree that you will not attempt multiple registrations with the express interest of causing disruption, damage or any other malicious action against pi-tag.com.

You may not violate any applicable laws or regulations, create a false identity for the purposes of misleading others, use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of pi-tag.com or other user or usage information or any portion thereof.

You agree that pi-tag.com has no responsibility or liability for the deletion, corruption or failure to store any account data or other content maintained or transmitted by the service.  PI-TAG.COM MAKES NO WARRANTY THAT ANY SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.  pi-tag.com reserves the right, in its sole discretion, to terminate your access to the pi-tag service or any portion thereof at any time, without notice.

pi-tag.com may also terminate or suspend your access to pi-tag.com for inactivity, which is defined as failing to log into pi-tag.com for an extended period of time, as determined by us. The amount of time that pi-tag.com currently considers as an "extended" period of time is currently 1 (one) year.  Upon termination of the pi-tag.com service, your right to use pi-tag.com immediately ceases.

You agree that you will not attempt to send messages to any person for any reason other than for the purpose of helping to reunite someone with their lost pi-tagged item.  Accounts that are used for any purpose other than tagging will be locked and no refund will be made on any tags or labels already purchased.

pi-tag.com reserves the right to log you out of pi-tag.com at any stage without warning and you agree that all pi-tag sessions are limited to 20 (twenty) minutes after which, you will be logged out of pi-tag.com automatically if you have not yet done so manually.

Account Activation

Following a successful registration, all pi-tag users must activate their account before using the pi-tag system.  Registered users will not be contactable via the pi-tag system until their account has been successfully activated.  Furthermore, you will be unable to log into an unactivated account.  Activation codes will be emailed to the registered email address of all registered users.

Once received, users must activate their accounts by entering the Activation code into the box provided and clicking on the 'Activate Account' button on the 'Activate Account' page.

Account Cancellation and pi-tag Number Ownership

pi-tag numbers remain the property and ownership of pi-tag Ltd, operating as pi-tag.com and may not be sold, loaned or hired without the full consent of pi-tag Ltd. No transfer of pi-tag number account details may occur without the knowledge of pi-tag Ltd and any transfer must then occur through the pi-tag system.

It is your right to cancel your account and have your personal details removed from the pi-tag database at any time.  pi-tag numbers cannot be retained following account cancellation and will eventually be reassigned to a new registered user.  Account cancellation will occur between 7 and 14 days from the date of the cancellation request, provided no further request to retain the pi-tag account has been received.

pi-tag account cancellation should be performed via the pi-tag contact us page. To prevent unlawful account cancellation, following an account cancellation request, a pi-tag email will be sent to the registered contact email address of the account holder.  Provided no reply is received to this email, account cancellation will continue after 7 days from the date of the request.

pi-tag users wishing to cancel their account may also contact pi-tag.com from the pi-tag contact email address used during account registration. You must include your name, pi-tag contact email address and pi-tag number in your cancellation request. If you are unable to use email, you should write to the address that appears at the bottom of these conditions.

Privacy Policy and Data Protection

We do not use the information we collect about you for anything other than providing other pi-tag users with a way to access your contact details for the purposes of correspondence.

We will never sell or share personal information to third parties unless we have your full consent. However, we may provide aggregate information and statistics about our members and related site-information to our third party vendors, but this information and statistics will include no personally identifying information. Please note that we may release information in good faith as is reasonably necessary to comply with the law or protect our rights.

pi-tag.com considers the protection of children to be an important and responsible task. Because we are unable to verify parent/guardian approval for child registration, we are unwilling to store child contact data online. All pi-tag users must therefore be aged over 16 years of age.

IP Address Logging. The Internet Protocol Address of the computer that you used for pi-tag registration will be logged for security purposes. We will also log your computer IP Address whenever you log in to pi-tag.com or purchase something from our online shop.  We will only log your Internet Protocol Address for legal or safety reasons and to protect our members from unlawful contact.

pi-tag Ltd trading as pi-tag.com complies fully with the Data Protection Act 1998.  Information that we store on our servers is classified as public and private data. Public data can be viewed only by other pi-tag users and the pi-tag system administrators. Private data will only ever be viewed by the pi-tag system administrators.  The Information Commissioner has been notified that Personal Data is to be stored on our pi-tag servers.

No Unlawful or Prohibited Use

As a condition of your use of the pi-tag service, you will not use the pi-tag service for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the pi-tag service in any manner which could damage, disable, overburden, or impair any pi-tag service (or the network(s) connected to any pi-tag service) or interfere with any other party's use and enjoyment of pi-tag.com. You may not attempt to gain unauthorized access to any pi-tag service, other accounts, computer systems or networks connected to any pi-tag service, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the pi-tag.com web-site.

Linking

Links to third party Web sites may be provided on this Site. We have not reviewed all third party sites and do not control and are not responsible for any of these sites and their content. We do not endorse or make any representations about such sites or any information or materials found there, or any results that may be obtained from using them.

User Transmissions

We are always pleased to receive your comments and suggestions. If you post comments, suggestions, ideas, etc. (collectively “Submissions”) in response to any content on this Site, you grant us a non-exclusive, royalty-free, perpetual and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute and incorporate such Submissions and the names identified on the Submissions throughout the world in any media.

Disclaimer

This Site is provided “as is” and without express or implied warranties of any kind, including implied warranties of merchantability or fitness for any particular purpose. We do not represent or warrant that this Site will be uninterrupted or error free. In no event, will we be liable for any damage or cause of any kind based upon or resulting from any use or inability to use this Site. The information, software and services included in or available through the pi-tag service may include inaccuracies or typographical errors. Changes are periodically made to pi-tag.com and to the information therein.  We may make improvements and/or changes to pi-tag.com at any time.

You specifically agree that pi-tag.com shall not be responsible for unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through a pi-tag service. You specifically agree that pi-tag.com is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. In no event shall pi-tag.com be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the pi-tag service, with the delay or inability to use the pi-tag service, the provision of or failure to provide a service, whether based on contract, tort, negligence, strict liability or otherwise, even if pi-tag.com has been advised of the possibility of damages.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE PI-TAG SERVICE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE PI-TAG SERVICE.
